Terms and Conditions for the Provision of Event and Catering Services

These Terms and Conditions are the standardised terms for the provision of all event and catering services to all consumers of JCB Catering Limited, trading as The White Label registered in England under 970 6779 at the registered address of 1 The Nursery, Abingdon, Oxfordshire, OX14 4UA whose main trading address is No. 7 Heliport Industrial Estate, Lombard Road, Battersea, London, SW11 3SS.

All events are bespoke and created on an individual basis by the Company for the Client. The Company’s cancellation policy is that the Client is subject to a full payment if the event is cancelled within 7 days of the event, and 50% payment if the event is cancelled within 14 days of the event.

i. The Contract

All written or oral quotations govern the provision and agreement of services between the Company and the Client which will form the basis of any contract between the Company and the Client. The Company withholds the right to amend the quotation given any change in event or Client circumstance. In the event of conflict of interest between the Client and the Company, the Client is to be aware that any confirmation by the Client, either written and oral, of the Company’s services before the contract is created and provided shall be binding unless a variation is agreed to by the Company.

 ii. Quotation

If the Client wishes to amend any of the details from the initial quotation, the Client must notify the Company as soon as possible to ensure that the Company is able to make the required changes and revise any costs therefore incurred by the changes.

The Company should be informed of any changes in guest numbers by the Client no less than 6 working days before the event.

iii. Food and Event Services

Within the quotation, the Company will provide bespoke menu selector(s) which will be available on the date of the event. When accepting the quotation and giving confirmation of details, the Client will specify which of the bespoke menu options they require for their event.

If the Client is aware of themselves or any guests attending the event having specific dietary requirements and/or food allergies, this should be communicated to the Company prior to the event to ensure that the Company has sufficient time to accommodate these individuals. In the event that a large number of dietary requirements and/or persons with food allergies will be present at the event, the Company will advise the Client to 1) select items which cater for these requirements, or 2) the Company will revise the quote to include a new subsection to cater to these requirements. In the event that option 2 is required, the Client must inform the Company no later than 7 days prior to the event otherwise it is likely that these requirements may not be able to be accommodated.

The Client should be aware that the Company does not work in a nut free environment. Therefore, in the event of severe allergies, this must be discussed with the Company prior to the event.

The Company will endeavour to supply the chosen menu options by the Client as provided within the bespoke menu selector on quotation. In the event that elements of the option are not available, the Company will inform the Client and advise substitute menu options (whilst also taking into account any specific dietary requirements) for the Client to choose from.

In order to maintain and ensure compliance with food safety hygiene and health and safety legislation and regulations, unless agreed with the Company, the Client shall not provide any other catering services other than the chosen Company (The White Label) at the event. If the Client chooses to provide other catering services, the Company will have no liability or responsibility for the services or acts of any other caterer.

In the event that the Company provides any alcoholic beverages, the Company reserves the right to request ID from any of the Client’s guests at the event appearing under 25 years of age.

In the event that the Client requires the Company to provide a cash bar, the Directors of the Company are licenced to offer such a bar.

In the event that a cloakroom service is provided, the Company shall exercise reasonable care to all items left with the cloakroom assistants. The Company shall not be held liable for any possessions left at the end of the event as these items will be returned to the Client’s possession.

iv. Third Party Services

In the event that the Company provides a quotation to include third party services and whereby, in the circumstance beyond the Company’s control, the Company has to make any change in the arrangements to fulfil the Client’s requirements, the Company reserves the right to amend the latest quotation.

 v. Marketing and Advertising

Any image or descriptive text published by the Company are issued to advertise the Company’s services in giving an initial idea of the services. The Client is to be aware that this published matter is an illustrative demonstration of the Company’s abilities and should not be relied upon unless otherwise agreed with the Company.

vi. GDPR and How We Use Your Personal Information

The Company will process and store only the personal details of the Client which are submitted to us regarding an initial event quotation. The Company do not share information about the Client with third parties without the Client’s consent. All personal information about the Client will be removed from our systems after 2 years unless otherwise required for repeat events.

vii. Price and Payment

Unless otherwise agreed, the Client shall pay the Company an initial deposit of 80% of the most recent total price payable (as per the latest quotation) which is to include VAT. This payment must be paid before the Company’s services commence. This deposit is refundable in the event of cancellation of the event up to 14 days of the event. However, if additional services and provisions have been booked and allocated for the Client’s event (such as hotels, flights or international orders) before the 14 day period, the Company reserves the right to withhold the appropriate funds to cover these services and provisions.

The Client shall pay all amounts due within the first invoice under these Terms and Conditions without any deductions as required by law. Failure to do so will result in the Company reserving the right to take action including but not limited to cancelling or suspending the provision of the Company’s services.

The Client shall then pay the Company the remaining 20% of the total price payable (as per the latest quotation) which is to include VAT. Within this final payment, the Company is entitled to charge the Client for subsequent expenses relating to the event services including, but not limited to, travelling expenses, additional catering/food/drink expenses, material expenses and third-party losses. The Client shall pay all amounts due within the second invoice under these Terms and Conditions without any deductions as required by law. Failure to do so within 1-month post event will result in the Company reserving the right to take action including but not limited to charging interest in the outstanding payment amount at a rate of 5% per annum above the base rate of the HSBC Bank until the payment is made in full.

viii. Liability

In the event that electrical generators, kitchen plants and additional power supplies are required for an event, if the Client does not agree previously with the Company in the Company’s providing an emergency supply (where available), the Company will not accept any responsibility for the loss or resulting damage to the event caused as a result of any failure or interruption to the equipment.

ix. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires, the following expressions should be interpreted by the following meanings:

Additional Costs means any additional costs attributable to the provision of Additional Services to the Client by the Company.

Additional Services means any goods and/or services the Company may agree to provide to the Client.

Catering Services means the catering services which are to be provided by the Company to the Client as confirmed through written (email) or oral confirmation (phone call).

Client means any individual, firm or corporate body which enters into a written quotation and subsequent contract with the Company.

Company means JCB Catering Limited (T/A The White Label), registered in England and Wales under company number 970 6779 with the business address of No. 7 Heliport Industrial Estate, Lombard Road, Battersea, London SW11 3SS, telephone no. 0207 738 9119, website www.thewhite-label.com and email addresses ending in @thewhite-label.com.

Confirmation means the notification (either through written or oral) made by the Client that they wish the Company to proceed on the basis of the agreed quotation.

Contract means the contract for the provision of catering and event services between the Company and the Client.

Deposit means the advance payment to be made to the Company by the Client before the agreed event date.

Drink means the drinks provided and supplied by the Company to the Client as part of their agreed services.

Event means the event(s) provided as agreed between the Client and the Company within the written quotation.

Food means the food prepared and supplied by the Company to the Client as part of their agreed services.

Intellectual Property Rights means all patents, copyright and related rights, trade-marks, trade, business, domain names and any other intellectual property rights.

Invoice means the document containing the sum payable by the Client to the Company.

Price means the agreed sum payable as per the latest quotation for all agreed services, including additional variable costs.

Quotation means any written agreement or series of linked agreements submitted by the Company to the Client. Unless otherwise agreed, a quotation is valid for 2 months from the date of issue.

Services means the event services, catering services and any other additional services provided by the Company to the Client.

Terms and Conditions means these terms and conditions as amended from time to time.

Working Day means any day (other than Saturday or Sunday) on which ordinary banks are open for their full range of normal business in England.

Writing means and includes all forms of emails, fax or letters.
